What Happens to Your Kids If You Die Without a Will?

I had a friend recently tell me, “My husband and I don’t agree on who should be guardian of the kids if we died so we don’t have a will or trust.”
I’m going to say this with love.
That disagreement does not protect your kids. It puts them at risk.
If something happened to both of you and there’s no will, a judge who has never met your children decides who raises them.
Not you. Not your family. The court.
On top of that, everything goes through probate.
That means delays, legal fees, stress. And possibly family conflict at the worst possible time.
And I get it. Those conversations can be emotional.
You’re choosing who raises your babies.
Of course it brings up feelings about in-laws or siblings or who is more responsible, but your kids deserve having a real plan in place.
You don’t have to agree perfectly.
You just have to agree enough to put something in writing.
You can update it later. You can revisit it. But doing nothing - that’s the worst plan at all.
